How to Submit a DMCA Notice

To file a DMCA takedown notice, please send a written notice that includes all of the following:

  1. A description of the copyrighted work you claim has been infringed.
  2. The exact URL or location on the Website where the allegedly infringing material appears.
  3. Your full name, mailing address, telephone number, and email address.
  4. A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  5. A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.
  6. Your physical or electronic signature (or the signature of the person authorized to act on behalf of the copyright owner).

Notices that do not substantially comply with all six requirements above may not be actionable. We reserve the right to request additional information necessary to evaluate a notice and to reject notices that do not substantially comply with applicable law. Please submit notices to the designated copyright contact listed above.

By submitting a DMCA notice or counter-notification, you acknowledge and agree that the Company may forward the submission, including your contact information, to the affected user, the complaining party, or other third parties as necessary to process the claim, comply with the law, or protect legal rights.

Misrepresentations and Liability for False Notices

Under 17 U.S.C. Section 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys' fees, incurred by the alleged infringer, the copyright owner, the copyright owner's agent, or a service provider injured by the misrepresentation. Please submit DMCA notices only when you have a good faith basis to do so.

Submitting knowingly false, misleading, or abusive infringement claims may expose the submitting party to legal liability.

Counter-Notification Procedure

We will take reasonable steps to notify you when material you posted to the Website has been removed or access disabled in response to a DMCA notice.

If material you posted to the Website has been removed or access disabled in response to a DMCA notice, and you believe in good faith that the material was removed or disabled by mistake or misidentification, you may submit a counter-notification.

To be valid, your counter-notification must be in writing and include all of the following:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or disabled and the location at which the material appeared before it was removed or disabled.
  3. A statement, made under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your full name, mailing address, telephone number, and email address.
  5. A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, for any judicial district in which the Company may be found), and that you will accept service of process from the person who provided notification of the alleged infringement or that person's agent.

Counter-notifications should be submitted to the designated copyright contact listed above.

Upon receipt of a valid counter-notification, we will forward a copy to the party who submitted the original DMCA notice and inform them that we may restore the removed material in 10 business days. Unless the original complaining party files a court action seeking an order to restrain the user from engaging in the allegedly infringing activity, we will restore the removed material no sooner than 10 and no later than 14 business days after receipt of the counter-notification.

Repeat Infringer Policy

We have adopted and will reasonably implement a policy providing for the termination, in appropriate circumstances, of subscribers and account holders who are determined to be repeat infringers of copyrighted material. In determining whether a subscriber or account holder is a repeat infringer, we may consider the number of notices received, the nature of the alleged infringements, whether counter-notifications were submitted, the apparent legitimacy of the claims, and other relevant circumstances. Repeated DMCA notices identifying the same subscriber or account holder as the alleged infringer may result in the suspension or termination of their account, removal of associated business profiles, and forfeiture of any prepaid fees, in our sole discretion and consistent with the requirements of 17 U.S.C. Section 512(i)(1)(A).

General

Nothing in this policy constitutes legal advice, and parties should consult their own legal counsel regarding their rights and obligations under the DMCA and other applicable laws.

We reserve the right to modify this policy at any time by posting an updated version on the Website.
